Why contempt, costs of Rs 10 lakh not be imposed for challenging settled law on disability benefits, Punjab and Haryana High Court asks Ministry of Defence

Chandigarh,:-The Punjab and Haryana High Court has taken exception to the filing of petitions and appeals by the Ministry of Defence against disability benefits granted to defence personnel by the Armed Forces Tribunal (AFT).

“On the next date of hearing, learned arguing counsel for the petitioners will assist, as to why contempt proceedings may not be initiated against the department for filing of petitions against the orders passed by the AFT granting disability pension, once the issue regarding the same has attained finality with the decision rendered by the Supreme Court, a Division Bench comprising Acting Chief Justice Ritu Bahri and Justice Aman Chaudhary said in their order.
He will also assist as to why costs of Rs 10 lakh be not imposed upon the petitioner in this case,” the bench added while directing that a senior officer from the department concerned would remain present in court on the next date of hearing.

The Bench was hearing one such petition filed by the Union of India challenging the judgement of the AFT allowing disability benefits to defence personnel.
